1. Introduction and Acceptance of Terms

 

Welcome to the website of Java Lava (the "Site"), owned and operated by Johnny Rocks Spirit Co. ("Company," "we," "us," or "our"), located at 10123 SE Brittany Ct, Clackamas, OR 97015.

By accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must strictly stop using the Site immediately.

 

2. Age Requirement and Verification

 

THIS SITE MARKETING AND SELLING ALCOHOLIC BEVERAGES IS INTENDED ONLY FOR PERSONS AGED 21 YEARS OR OLDER.

  • Affirmation: By accessing this Site, you affirm that you are at least 21 years of age.

  • Verification: Age verification is required at checkout and upon delivery.

  • Misrepresentation: It is a violation of these Terms and potentially a criminal offense to misrepresent your age to purchase alcohol or to attempt to purchase alcohol for a person under the age of 21.

 

3. The "AccelPay" Network & Transactional Role

 

To ensure compliance with United States federal and state alcohol regulations (the "Three-Tier System"), Johnny Rocks Spirit Co. does not sell alcohol directly to consumers.

  • Role of AccelPay: We partner with AccelPay to provide e-commerce functionality. When you place an order on this Site, the transaction is processed by the AccelPay network.

  • Seller of Record: Your order will be accepted, fulfilled, and shipped by a licensed third-party retailer within the AccelPay network, not by Johnny Rocks Spirit Co. directly.

  • Applicability of Third-Party Terms: AccelPay’s Privacy Policy, Terms of Use, and conditions apply to the financial transaction and fulfillment of your order.

  • Data Sharing: By placing an order, you acknowledge that your order information will be shared with AccelPay and the designated licensed retailer to fulfill your order.

 

4. Shipping and Delivery

 

  • Signature Required: All shipments containing alcoholic beverages require the signature of an adult who is at least 21 years of age with a valid government-issued ID upon delivery. Packages cannot be left at the door.

  • Title and Ownership: Title to, and ownership of, all alcoholic beverages passes from the licensed retailer to the purchaser at the warehouse and state it is shipped from. By placing an order, you authorize the retailer to act on your behalf to engage a common carrier to deliver the order to you.

  • Restricted Locations: We (via the AccelPay network) cannot ship to P.O. Boxes or to states/counties where direct-to-consumer alcohol shipment is prohibited by law.

 

5. Product Availability, Pricing, and Refunds

 

  • Availability: All products are subject to availability. In the event of a stock shortage, the licensed retailer reserves the right to cancel your order and issue a refund.

  • Pricing: Prices are subject to change without notice. Errors in pricing on the Site are subject to correction.

  • All Sales Final: Due to state regulations regarding the return of alcohol, all sales are generally considered final.

  • Damaged Goods: If your product arrives damaged or if you receive the wrong item, please contact support@accelpay.io immediately to initiate a claim with the retailer.

 

6. Intellectual Property Rights

 

The content on this Site is the exclusive property of Johnny Rocks Spirit Co. and is protected by United States and international copyright, trademark, and other intellectual property laws.

  • Trademarks: "Java Lava," "Johnny Rocks Spirit Co.," the Java Lava logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company. You must not use such marks without the prior written permission of the Company.

  • Copyright: All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, "Content") is owned, controlled, or licensed by or to Johnny Rocks Spirit Co.

 

7. User Conduct

 

You agree not to use the Site to:

  1. Violate any local, state, national, or international law or regulation.
